Wausau man charged with OWI with child in vehicle

A Wausau man is facing felony charges after he was arrested for third-offense drunken driving with a child in his vehicle.

The Wisconsin State Patrol reported that Jose Alberto Medina Herrera, 33, of Wausau was stopped at 10:26 p.m. Sunday on Camp Phillips Road in Weston after an officer noticed a vehicle traveling without lights and deviating from his driving lane. Medina Herrera, who had a child younger than the age of 16 in his vehicle, was arrested on charges of operating while intoxicated.

Penalties for drunken driving are doubled when a child younger than the age of 16 is in a vehicle. Online court records show Medina Herrera, who faces two years incarcerated if convicted, was last convicted of OWI in 2005.
