The ruling by Brown County Circuit Court Judge Marc Hammer against the Oneida Seven Generations Corp.'s claim that the city of Green Bay arbitrarily rescinded their conditional use permit is a victory for all citizens no matter their opinion of gasification incineration.

The judge found the Oneida Tribe's LLC had made significant misrepresentations in the application process. Allowing any company to proceed with development after discovery of a fraudulent application would have set a bad precedent for Green Bay.
