Man arrested spitting and threatening during drunken driving arrest

A 43-year-old Oshkosh is being held without bond at the Winnebago County Jail after he spit at emergency responders while he was arrested for drunken driving Friday night.

An Oshkosh Police stopped the man at at 9:21 p.m. Friday after he saw the man driving without his headlights on near Third Avenue and Ohio Street. The officer took the man to the jail, where he then said he could not breathe, said Joe Nichols, spokesman for the Oshkosh Police Department.

When paramedics from the Oshkosh Fire Department arrived, the man started swearing at responders and spitting on the ground. He was then placed in an ambulance, but while being transported to Aurora Medical Center, he tried to get off the cot, while continuing to spit and swear, Nichols said.

The man made threats at the hospital, telling medical staff he would be back to "get even" with the hospital staff. Officers eventually placed a spit hood on the man and then transported him back to the jail after he was medically cleared, Nichols said.

A 3-year-old who was in the vehicle at the time of the man's arrest was taken home by a woman who was also in the vehicle, Nichols said.

The man was arrested for disorderly conduct, his first drunken driving offense and carrying a concealed weapon because he had a machete between the front and back seats in his vehicle, Nichols said.

He is being held without bond because of the threats he made to hospital and fire department staff.
