The owners of a Merrill gasoline station are suing the state in federal court in an attempt to halt a highway reconstruction plan they say will put them out of business.

Station owners, whose livelihood depends on access to Highway 51, seek an injunction to halt construction of a highway overpass because the Wisconsin Department of Transportation failed to hold an adequate public hearing on the project.
