A 36-year-old Marshfield man authorities say held two children upside down over a railing was sentenced in Wood County Circuit Court to two years probation.
David R. Batten also was ordered to pay $1,264, undergo any counseling deemed necessary, maintain absolute sobriety and have no contact with his victims for four counts misdemeanor child neglect. Two of the counts were reduced from a felony charge of recklessly endangering safety. During Batten's sentencing Wednesday, Wood County Circuit Judge Greg Potter stayed jail sentences of 30, 60, 90 and 120 days.
According to the criminal complaint, two children, ages 9 and 11, were staying with Batten at his Marshfield residence. The apartment they were staying in was filled with flying insects, molding food and garbage. The children were sleeping on the floor surrounded by broken glass and maggots.
One of the children told Marshfield officers his father had held him and his sibling out a window, over a banister, by their feet, according to the complaint.
