Summerfest sues Red Lobster for trademark infringement in slogan
Summerfest is suing Red Lobster for trademark infringement in a slogan.
The lawsuit was filed in U.S. District Court, in Milwaukee, but an electronic record of the case was not available Saturday.
Summerfest officials declined comment, but CBS 58 reported that the festival is suing the restaurant chain for their "Lobster and Shrimp Summerfest" slogan being used in advertisements..
Last year, Summerfest asked Red Lobster to stop their use of the slogan and the chain obliged — but it revived it this year.
Red Lobster is operated by Golden Gate Capital.
CBS 58 said Summerfest claims people will believe the restaurant is associated with the festival. The festival is asking for advertising to be removed and to be reimbursed for any damages or money lost.
